Data Act Statement – Data Access and Portability

1. Scope

This statement describes how Swizzonic enables its customers to access, retrieve, transfer and reuse the data associated with its hosting, domain name, email, website and infrastructure services, in accordance with Regulation (EU) 2023/2854 (Data Act).

This statement applies in particular to the following services:

  • Domain name registration
  • Web hosting
  • Managed WordPress hosting
  • VPS services
  • Email services
  • DNS management
  • Backup services

2. Data Made Available to Customers

Customers can access the data they create, upload, configure or control when using Swizzonic services.

Domain Name Services

Customers can access and manage the following:

  • Domain name registration information provided by the customer;
  • DNS zone configurations;
  • DNS records;
  • DNSSEC configurations;
  • Domain transfer information required to transfer a domain name to another registrar.

Hosting Services

Customers can access and export the following:

  • The content of their website;
  • Website source files;
  • Static and dynamic content;
  • Files accessible via FTP;
  • Hosting configuration files;
  • Application files;
  • Server-side resources associated with their hosting account.

Database Services

Customers can access and export the following:

  • MySQL databases;
  • Database schemas;
  • Database contents;
  • User-created database credentials and configurations.

Swizzonic documentation provides direct access to databases as well as remote connection capabilities.

Email Services

Customers can access and export the following:

  • Email messages;
  • Attachments;
  • Mailbox contents;
  • Contacts and mailbox configuration data, where available;
  • Backup copies available through email recovery features.

Email services are accessible through the standard IMAP, POP3 and SMTP protocols, as well as through the Webmail interface. Email export and import features are documented and supported.

Backup Services

Customers can access the following:

  • The backups they have selected;
  • Archived files;
  • Data sets stored within the subscribed backup services.

Backup services support transfers using the FTP, FTPS and WebDAV protocols.

VPS Services

Customers can access the following:

  • The contents of their virtual server;
  • Operating system data under their control;
  • Snapshots;
  • Backup copies;
  • File systems and applications installed by the customer.

Swizzonic VPS services include snapshot functionality and recurring backup features.

3. Access Methods

Customers can access their data using industry-standard interfaces and protocols.

4. Data Portability and Switching Providers

Swizzonic services are built around widely adopted technical standards.

Customers can migrate to another provider using, in particular:

  • Domain name transfer procedures;
  • Recreation of DNS records;
  • Downloads via FTP and FTPS;
  • Database exports;
  • WordPress migration tools;
  • Mailbox migration via IMAP;
  • Email export and import procedures;
  • Backup downloads;
  • VPS snapshots and backups, where available.

Swizzonic also publishes migration procedures that require access to FTP credentials and database connection details.

5. Data Formats

Depending on the service concerned, data may be made available using commonly adopted formats and protocols, including:

  • DNS zone records;
  • Website files;
  • SQL database exports;
  • Email messages (.eml);
  • ZIP archives;
  • Files transferred via FTP or FTPS;
  • Backup files managed through WebDAV.

Swizzonic documentation explicitly refers to email exports in ZIP and EML formats.

6. Categories of Data Explicitly Excluded

The following categories are generally not considered customer data for the purposes of data portability and are therefore excluded from data access or disclosure requests.

Security and Abuse Prevention Data

  • Threat detection data;
  • Abuse prevention systems;
  • Security alerts;
  • Fraud detection systems;
  • Internal incident investigations;
  • Vulnerability management logs.

Internal Operational Data

  • Infrastructure telemetry data;
  • Platform monitoring data;
  • Capacity planning information;
  • Internal service performance metrics;
  • Internal operational logs that are not accessible through customer interfaces.

Proprietary Technologies

  • Platform source code;
  • Internal orchestration systems;
  • Automation frameworks;
  • Internal deployment systems;
  • Proprietary monitoring and administration software.

Shared Environment Data

  • Data relating to other customers;
  • Information concerning shared infrastructure;
  • Confidential information belonging to third parties;
  • Internal network topology.

Information Subject to Legal Restrictions

Certain data may not be disclosed where doing so would:

  • Infringe the rights of third parties;
  • Create security risks;
  • Conflict with legal obligations;
  • Reveal trade secrets;
  • Infringe intellectual property rights.

7. Data Retention Limitations

Access to certain data may depend on:

  • The subscription status;
  • The service lifecycle;
  • Backup retention periods;
  • Applicable contractual terms;
  • Legal data retention obligations.

For example, Swizzonic documents specific retention periods for email recovery features as well as for certain service-specific backup capabilities.

8. Customer Responsibilities

Customers remain responsible for:

  • Retaining copies of exported data;
  • Safeguarding the credentials required for migration operations;
  • Verifying the integrity of exported data;
  • Managing transfers to third-party service providers.

The migration procedures published by Swizzonic require the use of FTP credentials and database credentials that are controlled by the customer.
